Jail Time for Post-Game Hockey Brawl, Being Appealed

A 23-year-old Calgary man sentenced to 30 days in jail Wednesday for assaulting a hockey linesman in 2006 will be filing an appeal, his lawyer says.

Robert Joseph Simard, who was convicted of kicking Rory McCuaig in face and knocking him unconscious in an off-ice brawl after a game, will serve his time on weekends beginning in August.

Simard’s lawyer, Alain Hepner, said the family is disappointed with the sentence, believing it is far too harsh, especially when compared to other hockey assault cases.

Is it just me, or does a 30 day jail sentence already seem like a pretty good deal for kicking a hockey official in the face and knocking him unconscious AFTER a game, and off the ice?

Seems like it could have been much harsher.

30 days seems light, but I’m sure it doesn’t feel that way when it’s you facing the time.  Not that he didn’t earn it.

BTW: What would be the sentence for kicking a linesman in the face ON the ice?

I gotta think the guy should do his 30 days and call himself lucky. Of course, I’m not faced with the prospect of prison for what would likely be a loooong 30 days.

Tapeleg—I have no idea what the sentence should be in that case. I only meant to suggest that it’s easier to imagine it may have been an accident in an on-ice brawl than the way it occurred.

Shane—You’re right - no matter what, 30 days would feel very long if we were the ones facing that jail time. smile
